Marketer Programme Terms
1. Application
Anyone who submits an application asks Tswelelang to consider them for the marketer programme. The information supplied must be accurate.
2. Approval
Tswelelang may accept, decline or request further information. Submitting an application does not guarantee approval.
3. Marketer status
If approved, the person becomes a Tswelelang Marketer with a unique marketer code. Approval does not appoint the person as an attorney, debt counsellor, financial adviser or employee.
4. No guarantee of acceptance
Tswelelang may refuse an application without creating an obligation to provide reasons beyond what it chooses to share.
5. Independent commission arrangement
The programme is a commission-based referral arrangement. It does not automatically create an employment relationship, salary or guaranteed income.
6. Referrals
Marketers introduce genuine prospective clients who may benefit from Tswelelang services. Marketers must obtain permission before submitting another person’s information.
7. Duplicate referrals
If two marketers refer the same person, Tswelelang will consider timestamps and whether the referral is genuine. As a working rule, the first valid referral is considered, unless Tswelelang determines otherwise (for example in cases of error, fraud or a prior existing client relationship).
8. Qualifying referrals
A referral does not automatically qualify for commission. The referred client must meet applicable requirements and the matter must reach the qualifying stage determined by Tswelelang.
9. Commission
Commission is earned on qualifying referrals in accordance with Tswelelang’s marketer terms and applicable commission structure. Commission depends on the service and qualifying referral. Amounts are not advertised as guaranteed.
10. Payment timing
Payment timing follows Tswelelang’s commission rules after a referral is recorded as qualifying and payable.
11. Reversals
Tswelelang may reverse commission where a matter fails, is cancelled, was duplicated, was obtained by misconduct, or was paid in error.
12. Fraud
Fabricated referrals, identity misuse, purchased or scraped contact lists and similar conduct may result in decline, termination and referral to authorities where appropriate.
13. Misconduct
Misleading advertising, harassment, unauthorised fees, impersonation of professionals, or receiving client money without authority is prohibited.
14. Advertising
Marketers must use accurate, approved information. Social-media posts must not guarantee results or create the impression that the marketer is a regulated professional merely by joining the programme.
15. Intellectual property
Tswelelang logos, documents and materials remain Tswelelang’s property and may not be altered deceptively.
16. Confidentiality
Personal information of prospective clients and of Tswelelang must be protected.
17. Personal information
Processing is described in the Privacy Policy.
18. Termination
Tswelelang may suspend or remove a marketer subject to these terms, particularly for misconduct, misleading advertising, fraud or abuse. A marketer may also withdraw by written notice.
19. Disputes
Parties should first raise disputes with Tswelelang in writing.
20. South African law
These terms are intended to be governed by the law of the Republic of South Africa.
21. Changes to the programme
Tswelelang may update programme rules, commission wording and these terms. Material updates should be communicated through official channels.
